1. Agreement
By accessing or using Ensyra.ai Platform, you agree to these Terms of Service and the Privacy Policy. If you use Ensyra on behalf of an organization, you represent that you are authorized to bind that organization.
If a signed order form, data processing agreement, or written contract applies to your organization, that document controls where it conflicts with these terms.
2. The Service
Ensyra is a business platform for commerce intelligence, customer context, connector management, reporting, segmentation, ROI analysis, and recommended commercial actions. The service may include AI-assisted summaries, explanations, and suggestions.
Ensyra may update, improve, limit, or discontinue features as the platform evolves. Ensyra will try to avoid material disruption, but the service is not guaranteed to be uninterrupted or error-free.
3. Accounts and Security
- Users must provide accurate account information and keep credentials secure.
- Organizations are responsible for assigning roles, removing users who no longer need access, and reviewing activity in their workspace.
- Users must not share passwords, bypass authentication, probe the service for vulnerabilities, or access data without authorization.
- Ensyra may suspend access if it reasonably believes an account is compromised, unlawful, abusive, or creates operational risk.
4. Customer Data and Connectors
Customers retain ownership of their data. Customers grant Ensyra the rights needed to host, process, analyze, display, transform, and transmit customer data to provide the service and customer-enabled connectors.
Customers are responsible for ensuring they have the necessary rights, permissions, notices, consents, and lawful bases for data connected to Ensyra, including customer profile data, order data, campaign data, search data, and output-channel permissions.
5. Google Search Console
If you connect Google Search Console, you confirm that you are authorized to grant Ensyra read-only access to the selected Search Console properties. Ensyra uses the https://www.googleapis.com/auth/webmasters.readonly scope to provide visible demand, query, landing-page, category, and seasonality features in the workspace.
Ensyra's handling of Google API data is described in the Privacy Policy and is subject to the Google API Services User Data Policy, including the Limited Use requirements. You may disconnect Google Search Console by deleting or disabling the connector or by revoking access from the connected Google account.
6. AI, Recommendations, and Output Channels
Ensyra provides analyses, forecasts, summaries, segment suggestions, recommended actions, and AI-assisted explanations as decision support. These outputs are not guarantees of revenue, profit, customer behavior, legal compliance, or campaign performance.
Customers remain responsible for reviewing and approving actions, campaign content, discounts, suppression decisions, segments, exports, and messages before using them in business operations or customer communications.
7. Acceptable Use
- Do not use Ensyra for unlawful, deceptive, discriminatory, harmful, or privacy-invasive purposes.
- Do not upload malware, secrets that are not needed for configured connectors, or data you are not allowed to process.
- Do not use Ensyra to send spam, violate channel consent rules, evade platform policies, or target people in prohibited ways.
- Do not resell, sublicense, scrape, reverse engineer, overload, or interfere with the service unless Ensyra has agreed in writing.
8. Fees and Access
Fees, billing terms, usage limits, support levels, and subscription periods may be set out in an order form or other written agreement. Ensyra may suspend or end access for non-payment where permitted by the applicable agreement and law.
9. Intellectual Property
Ensyra and its licensors retain all rights in the service, software, workflows, models, designs, documentation, and brand assets. Customers may use the service only as permitted by these terms and any applicable agreement.
Feedback may be used by Ensyra to improve the service without restriction or obligation, provided Ensyra does not disclose customer confidential information in doing so.
10. Confidentiality
Each party may receive confidential information from the other. The receiving party must protect that information with reasonable care and use it only for purposes related to the service, except where disclosure is required by law.
11. Disclaimers
Except as expressly stated in a written agreement, Ensyra is provided "as is" and "as available." Ensyra disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation to the maximum extent permitted by law.
Ensyra is not a substitute for professional legal, privacy, financial, tax, or compliance advice.
12. Liability
To the maximum extent permitted by law, Ensyra is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption.
Any aggregate liability is limited to the amounts paid for the service during the 12 months before the event giving rise to the claim, unless a separate written agreement states otherwise or applicable law does not allow that limitation.
13. Termination
Either party may terminate access as provided in the applicable agreement. Ensyra may suspend or terminate access if continued use creates security, legal, operational, or policy risk. After termination, Ensyra may retain or delete data according to the Privacy Policy, applicable agreements, and legal requirements.

14. Governing Law
Unless a written agreement states otherwise, these terms are governed by the laws of the Netherlands, without regard to conflict-of-law rules.
